Terms of Service

1. Acceptance of Terms

By accessing, browsing, registering, or otherwise using Liberty Bells (the "Service"), you ("you" or "User") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), together with the Privacy Policy and Cookie Policy, which are incorporated herein by reference.

If you do not agree to these Terms in their entirety, you must not access or use the Service.

These Terms constitute a binding legal agreement between you and Liberty Studios (as defined in Section 3). Your continued use of the Service following any update to these Terms constitutes acceptance of the updated Terms.

2. Eligibility & Geographic Restrictions

2.1 Age

You must be at least eighteen (18) years of age to use the Service. If the legal age of majority in your jurisdiction is higher than 18, you must meet that higher threshold. The Service is not intended for and may not be used by minors under any circumstances.

2.2 Restricted Jurisdictions

You represent and warrant that you are NOT located in, a resident of, a citizen of, or accessing the Service from any of the following jurisdictions:

• The United States of America, including its territories, possessions, and military bases
• The European Economic Area (EEA), including all member states of the European Union, Iceland, Liechtenstein, and Norway
• The United Kingdom of Great Britain and Northern Ireland
• Canada
• The People's Republic of China (including Hong Kong and Macau Special Administrative Regions for purposes of these restrictions)
• The Islamic Republic of Iran
• The Democratic People's Republic of Korea (North Korea)
• The Syrian Arab Republic
• The Republic of Cuba
• The Russian Federation, including the Crimea region, the Donetsk People's Republic, and the Luhansk People's Republic, or any area otherwise subject to comprehensive territorial sanctions
• Any other jurisdiction subject to comprehensive U.S. OFAC, EU, UK, or UN sanctions

2.3 Sanctions & PEP Attestation

You further represent and warrant that you are not (a) listed on any sanctions list maintained by the U.S. Office of Foreign Assets Control (OFAC), the United Nations Security Council, the European Union, His Majesty's Treasury (UK), or any other equivalent authority; (b) a Politically Exposed Person (PEP) or a family member or close associate of a PEP for purposes of any applicable anti-money-laundering regime.

2.4 Enforcement

Liberty Studios may, in its sole discretion, employ technical measures (including but not limited to IP-based geolocation) to enforce these restrictions. Circumvention of such measures through use of virtual private networks, proxies, or any other means constitutes a material breach of these Terms.

3. Service Operator

The Service is operated by Liberty Studios, a pseudonymous development collective. Liberty Studios is not currently incorporated as a legal entity in any jurisdiction. Users acknowledge that they are interacting with a pseudonymous service operator and that this status is material to their decision to use the Service.

References in these Terms to "Liberty Studios," "we," "us," and "our" refer collectively to the individual or individuals operating the Service under the Liberty Studios brand. Liberty Studios reserves the right, but has no obligation, to incorporate as a legal entity at any future time, and any such incorporation shall not retroactively affect liabilities or obligations under these Terms.

4. Account & Wallet

4.1 Authentication

Access to the Service may be granted via local browser identity (callsign and locally-stored profile), or, at Liberty Studios' option in a future release, via cryptocurrency wallet-based authentication. You are solely responsible for safeguarding any credentials, private keys, recovery phrases, or wallet seed material associated with your access to the Service.

4.2 Single Account

You may maintain only one (1) active account on the Service. Operating multiple accounts ("multi-accounting") to acquire additional Cubes, manipulate matchmaking, or for any other purpose constitutes a material breach of these Terms.

4.3 Loss of Access

Liberty Studios has no ability to recover lost credentials, lost wallet seed phrases, or lost local profile data. Loss of access through any cause is the sole responsibility of the User and Liberty Studios shall bear no liability therefor.

5. Description of Service

Liberty Bells is a web-based trading card game accessible via standard HTTP/HTTPS protocols. The Service does not currently incorporate any blockchain functionality, smart contracts, or cryptocurrency tokens. All gameplay, in-game currency (Cubes), card collections, ranks, and progression occur entirely on Liberty Studios servers as a traditional centralized web application.

Liberty Studios may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

6. Game Mechanics

6.1 General

Liberty Bells is a turn-based competitive card game. Each match consists of six (6) turns played across three (3) lanes, with players selecting cards from a deck of twelve (12) cards. Match outcomes are determined by lane control as described in the in-game rules. Liberty Studios may modify card abilities, statistics, costs, balance parameters, and all other game-design elements at its sole discretion at any time.

6.2 Card Acquisition

Cards become available to the User through a progression system that may include, without limitation: a starter pool granted upon account creation, victories in standard battles, completion of campaign challenges, and resolution of daily puzzles. Acquisition criteria, drop rates, and progression mechanics may be modified at Liberty Studios' sole discretion.

6.3 Matchmaking and Gameplay Balance

To ensure timely matchmaking, balanced gameplay experiences, and competitive integrity, our matchmaking system may at its sole discretion incorporate AI-controlled opponents calibrated to the player's current skill level. These AI participants are designed to provide gameplay consistent with human opponents of comparable skill. The Service does not guarantee that any specific match will be against a human or AI opponent.

6.4 No Real-World Value

Match outcomes, card collections, rank progression, Cubes balance, and all other in-game elements have no monetary or real-world value. They exist solely as components of the entertainment experience offered by the Service.

9. Risk Disclosure

You acknowledge that use of the Service involves risks, including without limitation the following:

• Operational risk: the Service may experience downtime, data loss, bugs, or be discontinued at any time;
• Pseudonymity risk: Liberty Studios operates pseudonymously, which limits your recourse in the event of disputes or losses;
• Regulatory risk: the legal status of online games, in-game currencies, and potential future tokens may change in any jurisdiction at any time, including in ways that could render the Service unavailable to you;
• Token risk: if a token is ever launched, holders may face total loss; tokens may have no liquidity, may be delisted, may be subject to network failures, hacks, regulatory enforcement, or other adverse events;
• Third-party platform risk: if a token is ever launched on a third-party platform, that platform may fail, be hacked, change its rules, or impose its own restrictions;
• Technical risk: blockchain technologies (if and when introduced) involve irreversible transactions, smart contract bugs, key loss, and exchange counterparty risk;
• Tax risk: any future token receipt or use may have tax consequences in your jurisdiction for which you alone are responsible;
• Force majeure: the Service may be affected by events outside any party's control, including but not limited to acts of God, war, civil unrest, government action, network failures, and pandemics.

You assume all such risks. You should not use the Service if you cannot afford to lose any time, effort, or resources invested in it.

10. Pseudonymous Operation Disclosure

11. Prohibited Conduct

You agree NOT to:

• access or use the Service from any restricted jurisdiction listed in Section 2.2;
• use any automated system, bot, script, scraper, or other software to interact with the Service in a manner not expressly permitted (note: bots offered by Liberty Studios as part of matchmaking are permitted; user-operated bots are not);
• register, operate, or control more than one account;
• engage in collusion with other players, including coordinated loss or win-trading;
• exploit bugs, glitches, undocumented features, or any unintended Service behavior to acquire Cubes, cards, ranks, or any other in-game element;
• reverse-engineer, decompile, disassemble, or attempt to derive source code from any part of the Service;
• interfere with, disrupt, or place an undue burden on the Service infrastructure (including DDoS, fuzzing, or unauthorized load testing);
• harass, threaten, defame, dox, or otherwise abuse other Users, Liberty Studios personnel, or any third party;
• use the Service for any unlawful purpose, including without limitation money laundering, terrorist financing, tax evasion, or violation of any sanctions regime;
• impersonate Liberty Studios, any Liberty Studios persona, or any other User;
• attempt to manipulate Cube accumulation, rank progression, matchmaking outcomes, leaderboard standing, or any other Service element through any means not contemplated by the Service;
• circumvent any technical access restriction, geofencing measure, or rate limit imposed by Liberty Studios.

12. Anti-Cheat

Liberty Studios reserves the right, but assumes no obligation, to monitor User behavior for compliance with these Terms. Liberty Studios may, at its sole discretion and without prior notice:

• suspend, freeze, or permanently terminate any account suspected of breach;
• void, deduct, or roll back any Cubes, cards, ranks, or progression suspected of being acquired in breach of these Terms;
• exclude any account from current or future events, including without limitation any potential future token distribution;
• retain anonymized telemetry, gameplay logs, and IP addresses for the purpose of detecting and investigating misconduct.

Decisions made under this Section are final and not subject to appeal beyond a single written request submitted through the official channels in Section 23.

13. Intellectual Property

The Service, including the "Liberty Bells" name, "Liberty Studios" brand, game design, card names, card artwork, opponent designs, location designs, music, sound effects, source code, user interface, and all other components, is the intellectual property of Liberty Studios and/or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for personal, non-commercial entertainment purposes in accordance with these Terms. No other right, title, or interest is granted.

You may not copy, modify, distribute, sell, publicly perform, publicly display, create derivative works of, or otherwise exploit any portion of the Service without prior written authorization from Liberty Studios.

14. Disputes & Arbitration

14.1 Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your use thereof shall be resolved exclusively through final and binding arbitration, conducted by a single arbitrator administered under the rules of the International Chamber of Commerce ("ICC") or an equivalent international arbitration body selected by Liberty Studios. The seat of arbitration shall be a neutral forum selected by Liberty Studios; the language of arbitration shall be English.

14.2 Class Action Waiver

You and Liberty Studios each agree that any arbitration shall be conducted on an individual basis only and not as a class, collective, or representative action. The arbitrator shall have no authority to consolidate claims or to preside over any form of representative proceeding.

14.3 Waiver of Jury Trial

You expressly waive any right to a trial by jury and any right to participate in a class action.

14.4 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual claim in any competent small claims court if such claim falls within that court's jurisdictional limits and is brought on an individual basis only.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.
• Liberty Studios shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, lost goodwill, business interruption, or any loss arising from your use of or inability to use the Service.
• Liberty Studios' total aggregate liability arising out of or relating to these Terms or the Service, regardless of legal theory, shall not exceed fifty United States dollars (USD $50).

You acknowledge that this limitation is a fundamental basis of the bargain between you and Liberty Studios and that Liberty Studios would not provide the Service without such limitation.

16. Indemnification

You agree to indemnify, defend, and hold harmless Liberty Studios and its operators, contributors, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• your access to or use of the Service;
• your breach of these Terms or any representation or warranty herein;
• your violation of any applicable law or third-party right;
• your accessing the Service from a restricted jurisdiction.

17. Termination

Liberty Studios may suspend, restrict, or terminate your access to the Service, in whole or in part, at any time, for any reason or for no reason, with or without notice.

You may terminate your use of the Service at any time by ceasing access.

Upon termination, all licenses granted to you under these Terms shall immediately cease. Any Cubes, cards, ranks, or other in-game elements associated with your account shall have no value upon termination and shall be forfeited without compensation.

Sections 7, 8, 9, 10, 13, 14, 15, 16, 19, 20, and 21 shall survive any termination of these Terms.

18. Modifications

Liberty Studios may modify these Terms at any time. Material changes will be communicated through the in-game interface or the Service website at least seven (7) days prior to taking effect. Continued use of the Service after the effective date of any modification constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must cease using the Service.

19. Governing Law

Pending incorporation of a legal entity behind Liberty Studios, no specific national governing law is designated; the dispute-resolution procedure in Section 14 shall govern all disputes. Upon incorporation, Liberty Studios may designate a governing law by notice published on the Service, which shall apply prospectively from the notice date.

20. Tax Responsibility

You are solely responsible for determining, reporting, and paying any taxes, duties, levies, or assessments that may apply to your use of the Service in your jurisdiction. If a token is ever distributed and you receive any such token, you are solely responsible for any tax consequences of such receipt, holding, sale, or other disposition.

Liberty Studios provides no tax advice and makes no representations about the tax treatment of any aspect of the Service in your jurisdiction. Consult a qualified tax advisor.

21. Severability

If any provision of these Terms is held by an arbitrator or court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to render it enforceable, or, if such modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

22. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Liberty Studios concerning the Service and supersede all prior or contemporaneous oral or written agreements, communications, and proposals.

23. Contact

Communications to Liberty Studios should be sent through the official channels published on the Service's primary website or in-game interface. Liberty Studios does not maintain any other official communication channel. If you receive a communication purporting to be from Liberty Studios through any other channel, including private messages on third-party platforms, treat it as fraudulent and ignore it.

Liberty Studios will never request your private keys, seed phrases, passwords, identity documents, or payment of any kind in exchange for account access, support, or token allocation.
